The son has no legal right to evict the father from the house owned by the father. The said senior citizen may file a complaint with the police and most often the police will call both the parties and settle the matter. The senior citizen can file a suit for injunction by attaching all documents showing his ownership and police complaint, and seek an order of injunction, restraining the son from ousting him from his own property. If the senior citizen is unable to maintain himself, he can file an application for maintenance under the provisions of The Maintenance and Welfare of Parents and Senior Citizens Act of 2007.
