1.The Maintenance and Welfare of Parents and Senior Citizens Act was enacted in the year 2007. The object of the said Act is to make provision for basic necessities like food, clothing, shelter and medical treatment of parents/ senior citizens who are unable to maintain themselves. 2.An application will have to be made by the parent/ senior citizen against the children/relative before the Maintenance Tribunal which is constituted for each Sub-division, seeking appropriate relief.Any legal heir of the childless senior citizen,and is in possession or who would inherit his property after his death, would also be liable to pay maintenance to the senior citizen. 3. The application can be made in the district where the senior citizen resides or last resided, or in the district where the children/ relative resides. 4.After receiving an application, the Maintenance Tribunal will send a notice to the children or relative and then hold an inquiry in order to determine the amount of maintenance. 5.Thereafter an order is made by the Tribunal, after taking into account the the means of the children/ relative, which shall not exceed Rs.10,000/- per month. 6.When an order is made, fixing the quantum of maintenance, the children/ relative shall deposit the amount within 30 days of the pronouncement of order. 7. Any parent/senior citizen who is not satisfied with the order of the Tribunal, may file an appeal before the Appellate Tribunal constituted for each District, within 60 days from the date of order of the Tribunal. 8. After hearing both the sides, the Appellate Tribunal pass its order on the appeal. 9.The Act also enjoins the State Government to establish and maintain old age homes, and further ensure that Government hospitals provide beds for all senior citizens, and also to take steps to protect the life and property of senior citizens. 10. Any person who wilfully abandons a senior citizen shall be punishable with imprisonment upto 3 months or fine upto Rs.5,000/- or both.
